Please read these Terms and Conditions (“Terms”) carefully before accessing or using the services and online portal (“Portal”) provided by Buildium and licensed to Box Residential Property Management (“Company”, “we”, “us”, or “our”). By accessing our services and Portal, you (“you” or “the user”) agree to be bound by these Terms.

1. Acceptance of Terms

By using our services, website, and online Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our services.

2. Modification of Terms

We reserve the right to update or change these Terms at any time. Any changes will be effective immediately upon posting to the Portal. Your continued use of the services after any changes constitutes acceptance of those changes.

3. User Responsibilities

You agree to provide accurate and up-to-date information through the Portal and to maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account.

4. Communications and Notices

You agree to receive all official notices, documents, and communications from Dickens Court Homeowners Association (“HOA”) via the Box Residential owner Portal and/or by the email address provided in your account.
These communications may include, but are not limited to:

HOA meeting notices

Policy updates

Maintenance schedules

Dues and assessments

Violation notices

General community updates

Delivery through the Portal and/or email will constitute proper and sufficient notice, and you waive any right to receive such communications by mail or other physical means.

5. Privacy Policy

6. Limitation of Liability

Box Residential Property Management shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services or Portal. We do not guarantee uninterrupted or error-free service.

7. Termination

We reserve the right to suspend or terminate your access to the Portal and our services at our sole discretion, without prior notice, if you violate these Terms or misuse the Portal.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts located in Harris County, Texas.

9. Entire Agreement

These Terms constitute the entire agreement between you and Box Residential Property Management regarding the use of our services and supersede any prior agreements or understandings.

By accessing or using the services of Box Residential Property Management, you acknowledge that you have read and understood these Terms and agree to be bound by them, including the receipt of all Dickens Court Homeowners Association communications via the owner portal and/or email.
